Terms of Service

These terms govern your use of the Pinaki Agency website and services. By using our site or engaging us, you agree to them. Our software product Saathi has its own Saathi Terms and Refund Policy.

1. Who we are

Pinaki Agency is a digital agency in India offering web, app, ERP and software development services.

2. Services & quotes

Project scope, timelines and price are agreed in writing (proposal/quote) before work begins. Anything outside an agreed scope is a separate change request. Quotes are valid for 30 days unless stated otherwise.

3. Payments

• Projects are typically billed with an advance and milestone/final payments, as set out in your quote.
• Advance payments cover work already scheduled and committed and are non-refundable once work has begun, except as required by law.
• Final deliverables/handover follow full payment unless agreed otherwise.

4. Intellectual property

On full payment, project deliverables created specifically for you are yours. We may retain our own pre-existing tools, libraries and know-how, and may showcase the work in our portfolio unless you ask us not to in writing.

5. Your responsibilities

You’re responsible for providing accurate content, timely feedback, and the rights to any material you give us, and for the lawful use of what we build for you.

6. Warranties & liability

We deliver work with reasonable skill and care, but the site and services are provided “as is” without further warranty. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the work in question.

7. Third-party services

Projects may rely on third-party platforms (hosting, payment gateways, APIs) governed by their own terms; we’re not liable for their outages or changes.

8. Governing law

These terms are governed by the laws of India, with courts at our place of business having jurisdiction.
